Trial Mix

      Talking with the people at the trial, it appears the City never did produce Officer George's body cam video yet for weeks video was touted as the proof of Milly's guilt...Another officers's video was introduced as was security video from the restaurant.

      Be nice to see that publicly available.    Apparently the Mayor had ask about this incident early on but the CM said he wasn't familiar with it.  The Chief at the time has retired. And Council doesn't ask too many questions....

       And it was kind of low rent of the ADA to try and bring up the defendant's marital situation in the proceedings although the Judge smacked that down.  Apparently it was over an unrelated dispute over a sign directing patients from the Washington St office to her new office down the street. Police sought to use it to undermine her credibility, according to observers.

         Council will have no questions and will not be asked any...   Milly and her gal pals dined at Pete's last night and yes its true, Milly wore blue scrubs to the court proceedings .

Moving forward, all and every person accused of harassing a police officer will just use the alibi, “intent”. That’s it, no one will ever be able to be charged, do whatever you want to a police officer. I didn’t intend to push them, I didn’t intend to kick them, I didn’t intend to punch them, no, my intent was to kick the car door, my intent was to punch the window, my intent was to push the mirror. What a joke. Inside justice. Remember, it’s all intent. I was driving 95mph, but, my intent was the speed limit.

Hey Perry Mason. It wasn't up to the City to produce any evidence. The case was tried by the County (District Attorney's Office). Not the City. I know you don't like him, but you shouldn't always be pointing the finger at the Wag. What is your obsession with him??

I stole a snickers bar from doldos store on Bradley street. Was arrested. I told them yes, I left the premises with the candy bar, but, my intent was to eat it in the store. Dismissed. I also was arrested for DWI. My intent was just drive home though, not to get stopped by the police. Dismissed.

10:46 Intent has always been required. The law in NY stipulates it can be inferred from a defendant’s actions and/or words, but must be proven beyond a reasonable doubt. From the very beginning, it was a mystery how the prosecution could even seriously argue, much less prove beyond a reasonable doubt, that the purposes Ms. Smith’s actions were targeted to harass Police Officer George, rather than intended as part of an effort to reach the chocking victim.
Notably, they didn’t even bother charging attempted assault or obstructing governmental administration. They just charged harassment because “dissing a police officer” is not an offense.

It was 12:22, but that is beside the point. The County is responsible for trying cases in the city. That is why a Jefferson County assistant district attorney is in City Court everyday. Please try to educate yourself, Duh!
