No one is above the law but when you enforce the law, you are. Governor Hochul has issued an order to the NYS Liquor Authority not to enforce t(e 10AM opening today so people can watch the Olympic hockey gold medal game between the US and Canada. Gin mills can open at 6Am today only.
That’s innovative and resourceful governing, but it’s interesting a Governor can order a law not be enforced ……By God, the Legislature, in its infinite wisdom, carved out Sundays for a later opening…They did not say, except for when there is a sporting event.
I’m glad she did it and I will get dressed and go open, in case someone reads this.
Her order does not extend to areas of the state under a state of emergency for the coming storm on the coast.
Now nobody cares if a half dozen people come in early to watch a game, but the late announcement leaves little time for promotion and what of local police who see a bar serving the devile brew during church time ?
From a practicle standpoint the SLA is not going to be out doing anything today, but how binding is an executive order over the power of statute ? And the SLA could refuse to follow the order, but like I said...Who cares?
