WDT: NOT GUILTY ! Hillary Walks as Judge Rebuffs Rain Prosecution

   While widely expected due to the paucity of evidence, today's acquittal of Oral Hillary in the five year old murder of Garrett Phillips left beleaguered DA Mary Rain shocked and ashen  looking.
     The controversial prosecution was taken over by Onondaga DA William Fitzpatrick as the local DA was clearly in over her head. This case defines her tenure and ensures no second term in the $180K a year post as the Big County's prosecutor.

It will be interesting to see what Ms. Rain has in store next for the good people of St. Lawrence County. I would guess that she will not seek re-election but will she even be able to finish out her term? Her ethics issue regarding the unlicensed practice of law by her subordinate is still with the Third Department and I wouldn't be surprised if her Brady violation is added to that file. She may very likely find herself with a 6 month license suspension when all is said and done which makes it a bit difficult to serve as DA. Or will she beat the rush and just resign and move on to another county?

How sad, this Judge should be removed or censured.

A poor little boy's life was taken and the killer or people involved are walking the streets.

ONONDAGA CITIZENS SURELY MUST QUESTION any RAISE IN TAXES IF THE DA DEPARTMENT THERE CAN AFFORD TO LET THEIR ATTENTION GETTING HEAD GO TO A HIGH PROFILE TRIAL outside OF HIS NORMAL JURISDICTION HAVING LEFT HIS OFFICE COVER ALL THE LITIGATION GOING ON IN THAT COUNTY. ALSO HE IS HEAD OF A LARGE ORGANIZATION OF DA'S WHICH TAKES EVEN more TIME FROM HIS OFFICE.
I DID NOT SEE HIM IN THE COURT ROOM WHEN THE VERDICT WAS ANNOUNCED. SEEMS HE USED AN EXCUSE TO AVOID GOING TO THIS BECAUSE HE KNEW HE WOULD LOOK BAD.
JONEY MAHOMEY SHOULD GET RID OF THIS EGOMANIAC OF A DA. HE JUST WANTS TO MAKE HIMSELF LOOK GOOD.
OBVIOUSLY NICK HILLARY WAS NOT GUILTY. THE JUDGE SHOULD HAVE DISMISSED THE CASE. THE REAL QUESTION NOW IS WHAT THE POLICE ARE GOING TO PURSUE IN THIS CASE. OBVIOUSLY THE REAL MURDERER HOPES THEY WILL KEEP TRYING TO FIND EVIDENCE TO CONVICT HILLARY INSTEAD OF LOOKING FOR THE REAL MURDERER. i BET THEY WILL TOO, BECAUSE SOMETHING ROTTEN IS AT WORK IN THE POTSDAM POLICE DEPARTMENT AS WELL WHEN THEY AVOIDED ENTERING THE APARTMENT FORE SO LONG WHEN THEY HEARD THE BOY'S CRIES FOR HELP. i THINK THEY WERE IN ON IT AND COVERED FOR THE DEPUTY OR THE MOTHER AS THE BOY WAS DISCIPLINED. THEN WHEN THEY FOUND OUT HE WAS KILLED, THEY REALLY SHUT UP AND HOPED THE JUDGE WOULD FIND HILLARY GUILTY. THE MOTHERS TEARS. WERE THEY BECAUSE A MUREDERER WAS LET FREE, BECAUSE SHE WAS GUILTY HERSELF, OR SHE NEW HER LOVER WAS STILL AT LARGE NOW......

As much as I don't like it, this is our system. You have to respect it. Hillary had some advantages. Being black, we couldn't just go by evidence. We had to factor PC into the mix. We did; he walked. Oh well.

Congratulations to DA Rain for having the courage, tenacity and ethics to put the murderer on trial. Reasonable doubt is in the eye of the beholder. This is the closest thing we could get to justice. A few days in jail and a few years having to fight and worry about the outcome, is going to be all the punishment he gets, until Karma finishes the job.

If I were a betting man, I would put my money against this guy staying around here. But if he does, we can look forward to the civil trial and knowing this guy will have to forfeit all his earnings to the victim's family.

1:07 and also for 11:07 -- it's only a racial issue because morons like you say, think, or hope that it is. Yes, Mr. Hillary is black, and yes, the young man killed was white, and yes, Mr. Hillary was in a relationship at one time with the mother of the young man. So what?

All the evidence pointed away from NOT towards or on Mr. Hillary.

For you so smugly say he walked away implies guilty murderer on the streets. FYI: when people are NOT FOUND OR PROVEN guilty, that is moron, they are innocent, then they usually do walk, sometimes they run, other times they drive away, or are driven away - what is your sick point?

I guess you would have preferred an innocent man be fried to satisfy your opinion or imagination? Thank goodness our system is not based on some goober and his or her opinion about such matters. I also guess that's why you are not in the legal or law enforcement business.

Just stick to what you think you know best: Crystal Ball Gazing.

Danny, not sure why you claim 11:07 was making a racist comment. The only people who made race an issue was the defense - and they did raise it as a red herring. The only racist comment came from Hillary's side (calling people cracker).

Because someone is not guilty does not mean they did not do the crime. OJ was found not guilty criminally but civilly responsible.

The statement that all the evidence pointed away from Hillary shows you did not follow the trial closely. Evidence can be interpreted differently by different people but to say it all pointed away is naive. The grand jury indicted and a judge said their was sufficient evidence to uphold the indictment. Therefore, there must have been some evidence that pointed his way.

What we do know is he had motive. The mother testified she broke up with Hillary because her kids did not like him. (A reasonable person can think this is motive or can think it is not but it is evidence) He stated he was one place while video showed he lied and was somewhere else. Lying can be used as an indicator of guilt.

For you to so readily turn aside those that think a person who committed murder is walking freely on the streets shows that you are narrow minded and unwilling to consider those that have opinions differing from yours.

2:15 Among the more pathetic excuses I have ever read. DA Rain campaigned on "Justice for Garret". She brought the case prematurely and lost. Either the killer has now been exonerated or she went after an innocent man. If she had waited, DNA science and STRmix might have advanced to the point that it would habe led to admissible evidence, or somebody might have talked. That is why there is no statute of limitation on murder - but double jeopardy does apply. DA Rain just lost the biggest case of her career and is facing multiple ethics charges - congratulations???

5:12 - first of all 11:07 raised that point, not me.

Plus, and most-importantly, opinion no matter from whom never, ever outweighs the facts.

The evidence in this case did not point towards Mr. Hillary. Justice for the young boy killed was not served, but an injustice to nail Mr. Hillary based on opinion and illogical reason did not prevail, either.

Our system works.
