The prosecution has rested and the first defense witnesses were on the stand today in the Oral Hillary trial.

Sounds like the whole thing will be over soon.

Fitz and Insane Rain failed to present a case that was crossed the "beyond a reasonable doubt" threahold. I bet Catena upholds the defense's motion to dismiss and that will be the final nail in the coffin for her disastrous term.

DA Fitzpatrick proved that Hillary "probably" did it as DA Rain mostly watched. Not good enough.....

9:04 Is correct. Rain is done if she loses this one. No RINO county DA has ever lost a case before. Other than the last one who lost the Oxley case three times. but other than that...all DA's must win every case.

10:54 - Be serious, Rain based her whole campaign on getting "justice" in this case, and it is not like this is her only problem. BTW Oxley was convicted at the first two trials...
Rain will be lucky if her law license isn't suspended for ethics violations in the ongoing grievance investigation - good chance she doesn't make it to next year's election.

10:54 - Astute analysis. Of course, no DA has campaigned on a single case as Rain did when she marched Tandy Cyrus in front of the press during her bid for the office.

As for her predecessor, she wasn't much better. The 3rd Oxley trial never should have happened and she lost that one too and she was subsequently voted out of office as she should have been. Of course, Ms. Rain should be thanking Mr. Hillary for waiving a jury trial - almost zero chance of a mistrial and the need to subject herself to an "Oxley" repeat.

St. Lawrence County has been unfortunate when it comes to their choice of DAs and there don't seem to be any viable prospects on the horizon to replace her.

The prosecution is drowning in the reasonable doubt, without a bucket to bail. Fitz was made out to be fool when he found out at trial that another suspect was interviewed by police.

So what if they said he did it? They had a good video of him around the crime. He lied some during some of the questioning. So why would they trust him? Plus yes he is a real good choice in an investigation.

W ho are these insane people who support Mary Rain and look down on Nicole Duve. First of all Duve convicted Oxley.. Judge overturned on a technicality by Richards not her... She got a hung jury on the second trial.. The third trial was different in the fact the cops lies were brought out. She cant be blamed for that.. He had to be found not guilty.. The only thing she should have done is purjured the cops that lied and gone after Gary Niles for his part in this farce... There was nothing irresponsible or shady about her handling of this case or the case that Rain is now trying to win... Rains big mouth and false promises got her to this point.. And its obvious to most that Duve did the right thing in the Hillary case as there is no statute of limitations on murder. Rain will have ruined any chance in the future to try him.
My question to the bar association is simply Fitzpatrick was brought here to assist her and is doing the entire case.. Whats up with that?

4:51, The statute of limitations for the murder of this young boy ends when Hillary dies of old age. Justice cannot wait forever. Rain was right to bring the boyfriend who lied about when and how he hurt his foot to trial. She was right to try the case against the boyfriend who has so much circumstantial evidence pointing toward him, that it is beyond a reasonable doubt that he is not guilty.

If it doesn't result in a conviction, that is the way the ball bounces. That is why they say "try a case" instead of "guarantee a case. You know damn well, if the judge allowed the DNA evidence, you would just explain that away, way that the boy naturally had Hillary's DNA under his nails from their past benign encounters.

This case is the closest thing we get to justice and it was high time to give it a "try".

no seven oh four,he gets tried once,if acquitted, that is the end..he can go out in the street, shout yes I did it,and there isn't a damn thing that can be done..

7:04 no statute of limitations on murder, but double jeopardy will elinminate any chance of conviction (unless it wasn't Hillary). Justice delayed may not be good, but it sure beats justice denied. It was unethical to campaign on a promise to prosecute before she had an inside look at the evidence, and withholding potential exculpatory evidence was just another example of her unethical conduct. In the end Hillary owes Rain thanks - as soon as the verdict comes down he will "exonerated". Good thing Fitzpatrick volunteered to essentially take over the trial or it would have been a complete farce. BTW, when is the last time Rain did anything at this trial? Diuve may not have been great, but at least she could retain ADAs and avoid being disciplined for misconduct. The only question is whether Cuomo replaces Rain or if she is voted out next year. Wonder what the settlement of the wrongful prosecution case will end up costing SLC taxpayers?

7:04 - Man, I wish you had made yourself known to Insane Rain and Fitz. They needed a DNA expert like you during their Frye hearing based on your personal analysis for the DNA. They couldn'the have lost then. Except, the DNA found was in such small (trace) amounts that an analysis couldn't conclude whose DNA it was. It could have been Hillary's or maybe it was yours? STRmix was able to manipulate the statistical analysis (not genetic analysis) to align it with Hillary. They could do the same and align the statistical analysis with your DNA too. That is why the "science" behind trace sample matching isn't accepted yet - because it is unreliable and easily influenced.

Hillary may have done it but Fitz has an uphill battle today in closing. And Rain will just sit there at the prosecution table and shut up and color as she has done for the entire trial.

9:00, you are a dolt. The point was that it was better to put him on trial and roll the dice instead of waiting for him to die of old age. The same should be done for the police officer that killed his wife, er...I mean that found his wife dead in the road.

More likely that Hillary will have to pay for the wrongful death, than that he could ever win a wrongful prosecution case.

Yes it was unethical for Rain to "withhold" the "evidence" that was not even close to being exculpatory. But every single cop and DA does something similar in every single case. Why single this irrelvent instance out to be outraged over?

One thing about the Hillary case is that everyone with common sense knows that Hillary did it. With the Oxley trial, it wasn't even 50/50 that the guy was guilty. It could have just as likely been any of his other crackhead buddies or suppliers who did it. And the DA knew the evidence was fake in that case.

It is obvious that he killed the child, but that doesn't make him guilty in the eyes of the law. Don't confuse the two issues. If he wasn't the murderer, he would gotten on the stand and told everyone, everything that happened that day. Likewise he could have easily taken a polygraph and that would have virtually eliminated him as a suspect. But he chose not to.

Hopefully he is dumb enough to continue with his civil cases. Then he will be forced to take the stand to be questioned about all of the happenings leading up to, during, and after the murder. That will be the case to watch. There won't be any "slight of hands" concerning evidence admissibility. It will all come in.

8:46 clever retort! I am sure that there are others out there that are OK with Rain acting unethically (the grievance committee won't agree) but no one supports a cheater who is also a loser.....
After the verdict, both you and Rain will both l be "irrelven"
Hillary is the only winner here....
