This is a huge setback to "Insane Rain" and her fall guy, Fitz. If the defense is smart, they will seek a non-jury trial and that will be it for the Hillary saga, and Rain's tenure. I can only hope she blames the highly experienced DA, Fitz, for her failure...you know, the DA she had to have to make this case drag on as long as it has.
I don't blame Rain for this at all. What you have is a justice system afraid to prosecute THIS black guy. It wouldn't be PC.
That is why you don't gamble everything on one piece of evidence and surrounding circumstantial evidence.A little more patience and time and perhaps either science or other evidence could have caught up to make a more solid case.Now,it is tenuous,and if he is acquitted,it is see ya later.
It was a given that conviction would be difficult. Sometimes you have to accept that the justice will be in the form of making the culprit suffer through a trial.
The boy had the man's skin under his finger nails! That's the DNA! How could you not make a case from that? In my book he did it.
Tough break for the prosecution. However, DA Rain indicted Hilllary before there was any DNA match. Now everyone gets to see if she had evidence to back it up, or if this was just the consequence of an unethical campaign promise.
Ray - how do you know whose DNA he had under his fingernails? The original analysis was "inconclusive" which means just that - the experts couldn't tell whose it was. Glad you aren't on the jury - they need people who can read and comprehend to sit on that jury.
Seem to be some pretty strong opinions out there before any evidence has been heard - may be difficult selecting a fair jury. If there is a hung jury, Advances at NYS Police lab may be sufficient to allow them to certify STRmix DNA before a second trial (decision was evidentiary so can be revisited). Defense might want to waive a jury and get it over with ASAP.
There is talk that some new testing would hang him. But it is done now. Half ass freed another killer.
What happened to the days when the DA would work months to make sure a killer went away? Sometimes years. Now they plead everything, want it done fast, and are not doing their jobs.
