Judge Rules Ichibon Can Get the Boot | WWNY TV 7

    Judge Catherine Palermo has ruled in favor of property owners and will allow the eviction of the Ichibon Restaurant and nightclub from a Court Street building owned by land baron Brian Murray who owns numerous buildings around town.
      The ruling comes just after a weekend where three were arrested at the club and a decorative tree was destroyed allegedly by unruly patrons.
       The club began as Asian Fusion, a high end Asian restaurant. The current owner had trouble making it as a restaurant and resorted to functioning as a nightclub on Fridays and Saturdays drawing the attention of cops and the landlord with a variety of problems.
        Mr. Murray sought eviction on the grounds the use violated the lease.

This is the affirmative action judge who you put in place. If the tenant appeals her ruling, expect her ruling to be overturned.

It is certainly no stretch and very common for a restaurant to be in the bar business. Even if it was valid to argue that the tenant has "changed the use", it is not reasonable to withhold approval, as the contract forbids unreasonably withholding approval.

If they want to throw this guy out and do it legitimately, it needs to be because he is not maintaining order and a safe environment.

It's a moot point anyhow, their liquor license is history.

If it was NOW planning more apts downtown it would be OK, oh wait Former Counciler Steve Bradley is. Hope he uses the right windows.
