WDT: Rain Supporters Now Want Her Out...Thanks for Telling Us Now

     Mary Rain is proving vexing for those who advocated for her ascension to the office of DA of the Big County.  In an editorial, it is opined public officials should be able to finish their terms if they have not been convicted of a felony, but that if Ms. Rain had a shred of decency she would resign due to her demonstrated incompetance.
         When did she become inept ?  Who vetted the candidate who once elected was in  position to preside over the administration of justice for 120K people ?
          Now the frantic want Governor Cuomo to parachute in and rescue them from their lack of judgment.  I doubt Mr. Cuomo will oblige, nor should he.
          The power of the state manifested in police and prosecutors, buttressed by public demands for law and order, is a frightening thing, but she was elected and like her or not, she will finish her term,and run for reelection if she wants.
          To think someone being paid $3500 a week is going to give that up when she probably thinks she is doing a good job is laughable.

New York's constitution allows the citizens at large to elect District Attorneys and county-level judges. We are simply seeing the downside to that provision. The citizens at large lack the knowledge and experience to make an intelligent decision with regard to an attorney's competence, experience and temperment simply because they do not interact with those candidates on a daily basis. In reality, it is merely a high school popularity contest when it comes to electing people to these positions, especially Supreme Court Justices who must run in their judicial district which covers numerous counties.

Ms. Rain's election was a case-in-point. Those who worked in the legal profession in St. Lawrence County repeatedly said that while Ms. Duvé had her faults, she was much better qualified than Ms. Rain. The electorate-at-large merely saw Ms. Duvé's faults and voted "Anybody but Nicole" and the result was Ms. Rain's victory. Now, until she is either suspended from the practice of law by the Committee on Professional Standards or convicted by a court of law, she is entitled to serve as District Attorney, no matter how poorly she does it and the electorate of St. Lawrence County gets to line with their uneducated, reactionary choice.

One of her biggest problems is that she prosecutes cases. Here in Jefferson county we just plead them out for pennies on the dollar type sentences. The going rate for climbing a ladder and shooting someone is 11 years. Killing your baby in a hotel room is good for 12 months. Killing your kids in a fiery high speed chase is a couple years.

So someone like Hillary should just be offered a plea deal of 24 months. That's what we would do here.

739.. You just want to be critical for some reason.. Mary Rains middle name is plea bargain or dismissal.She is pesecuting a innocent man in the Hillary case. She has acted very suspiciously in this case to say the least.. Theres a deputy Sheriff who is or should be as equally a suspect as Mr Hillary. Her office has openly lied about evidence in this case and has openly twisted the truth about the judges knowledge of the case has been.. She is very vendictave in her handling of this person and became very angry when someone helped him with his bail and other expenses.. I dont know your DAs office or how it runs but its funded by a board of legislators just like ours. You seem to be very knowledgable so why dont you run for DA.. Or is it all in your head and your really just a complainer.

If she voluntarily resigns who takes over? By law her chief assistant takes over. He resigned recently. At least two others in the office are prosecuting with permission of the third department but have not been admitted. (And the one who got in trouble for prosecuting a felony does not have his name on the list of those that passed the February bar exam so he is out). the Gov. can appoint but he is notoriously slow at filling vacancies.


The Gov can appoint Nicole Duve. It would probably be enough of a boost for her to win again when the election comes up.

She, just like many elected officials, has fell out of favor. Maybe due to putting cases into court way before they were ready. But I can see two big ones she got screwed on. The kid's murder, and the drug deals gone bad murder, with a man who had a questionable record, and just wouldn't buckle under the lamp. People were yelling up high, get me some justice! She had not other choice but to try some kind of move. They both went sore. Lack of this or that. Rushed cases. That's what happens when feelings, and political crap gets involved in a court room. I would like to see her total conviction rate. Is it that bad?

Mary Rain will resign for sure.

When the Barn is on fire the rats will run.

Only one way out for her and that is to resign and move out of the county.

1008.. Think long and hard on your statement... Duve could be appointed and hold the office until the general election but would she really run..?? Would she risk another loss at the polls> lots of money to be made but she making a good salary now as Judge Richards law clerk and shes in a great position to run for Judge when Richards gets out. Hes about 62 so he has to retire in eight years mandatoraly but he could skip out early opening the door for the job she really wants. I,m not sure about your statement about who takes over... I know a Sheriff or Treasuer leave and while the next in command may take over temporaly the governor appoints until either a special election or the enxe general election..

7:08 sounds like he teaches some good courses at one of those fancy colleges in RINO county. People are too dumb to govern and let the smart adjunct professors make our decisions for us. Worked great with Obamacare. And all those appointed judges are doing a dandy job too.
