No Way This Guy Gets Convicted

   Forty nine year old Daniel Avery couldn't go to jail for breaking up that head shop because he was in the emergency room at the time. I hear he has one lung and a heart condition.
   What juror votes to convinct the guy for busting up a head shop that was selling bath salts to his 24 year old son ?
    I understand he had to be arrested....but he doesn't get found guilty...Period.

Whether he "found" guilty or not may/may not up to a jury or his peers - our system.

Nevertheless, by his own admission and evidence he is "guilty." There could be a lot lot of migigating circumstances and even if found guilty, the judge would, I think fine him (to pay for the damages and put him on one-two years of probation) ... that would be fair ...

What troubles me is that this man took his hostilities out on a business that sells a currently LEGAL product, albeit a bad one.

If my son came home drunk some night, do I have the green light to bust-up the liquor store or bar that provided the alcohol?

I also feel that he may have did the right thing, but what did he do to the son for purchasing the stuff to begin with. This kid is 24 he should know better then to buy it. I don't agree with the store selling this material but its legal. Its just as legal as alcoholic beverages and the "kid" was of the legal age. Mr. Mayor would you have turned him down if he wanted a beer?

And your point 7:48 is that he has only two more years to be on his daddy's insurance? Oh wait...Doheny likes that one too. He needs to quit hanging out with Patty before Hoffman gets back in the race.

At any rate...its the head shop's fault and not his adult sons. Definitely is not where he is because of his parenting. I am sure he was able to use his baseball bat type answers while parenting very effectively.

The kid is 24, an adult. His choice. If he was underage it would be a different story. How about giving some smokes, alcohol and drugs to the store owner's little children? I bet he would scream!

I don't care if my sons are 40, I still would tear the place down for putting them in the hospital.

Kids need their dad as long as they can have them. That's the messed up thing with todays world. Everyone wants their kid out at 18. Think about it. Did you see the Waltons smoking pot? Hell Jim-Bob almost died from smoking tobacco on the show. Kids need help all their lives. Jim-Bob had everyone in the family put a boot up his butt.

The places are not bars. They are places that sell the drug style of life. They sell the dream to people who have no dream. The nightmare. The person who puts down a bar knows nothing of it. They are weak or strong. Nothing in-between. I can go and drink one or five. I don't drive afterwards. I walk. I never have had a lick of trouble. Some just can't handle going to a grocery store. that's life. Some people are weak.

Don't stand up for these crap holes. That's all they are. People wgho go in them need a life. They need a girlfriend, a job, and maybe even church.

The dude that busted the place up, he wasn't correct to do so. But who knows till you have your kid sitting in a hospital and he or she might die or have damage to their mind. You might do more.

11:55 , I very strongly agree with you; I also might add that the laws of today, have a lot to do with the "legal" maturity of a person. What is really bad, we go after the "illegal" drug dealers, but the so-called"legal drug" dealers are free to do their business.

He should have focused his energy on his son, and the choices that he is making rather than going into the store like a mad man with a baseball bat. Not that I condone the business that place is involved in...but I hope this isn't one of those things were it's everyone else fault and the young adult who chose to be involved in the situation in the first place shares no blame from the parent's point of view. Just my opinion.

11:55 good for you that you can walk away from the bar after 1 or 5 and don't drive. But don't get all pious on us because a lot of people cannot do that and many bars have those people as their customer base.

ER's are full of people that are being treated for "alcohol was a factor" injuries. So are the graveyards. These head shops might be a notch worse with their designer drugs but the comparison to bars is still valid.

Regardless of his past, he shouldn't be charged, synthic drugs are screwing up people. His son was sent to the hospital because of glass cleaner. I think he did the right thing. I would have done it. Like Mr. Avery said there was a line of people waiting to get into the Tebb's he could have saved some lives by busting up the place.... It doesn't matter what age someone's child is or what choice they make to buy a drug like this. A parent will do any and everything to fight for their child(ren) no matter what!

Yea, I think it's best to leave me off of the jury too. While I don't believe in "mob rule" sometimes vigilante justice is better then the criminal justice system!

Mayor Graham, you have this completely right. I say take it to a jury. It will waste alot of taxpayers money when he is found not guilty or the jury won't agree because some parents will actually be on the jury. Why not give this guy community service to educate kids about the harmful effects of taking these drugs? 24 year old adult buying it.....14 year old kid buying it.....how many people exactly oh pious Watertonians does it take to die from it? I hope this makes national news. I hope a high profile attorney hears about this and offers pro bono services to Mr. Avery. At what age exactly does your child NOT become your concern?

I for one am behind you Mr Avery 100%. FACT-glass cleaner, bath salts, and synthetic weed ARE ILLEGAL and have been for about a month. So before you jump on here making dumb comments that are untrue get your facts right, Ever heard of google? I do understand that the son was 24 so what it's still his so so 24 or 42. I will always protect my child as long as there is breath in my body. Any loving parent would agree. MR Avery you are my hero it's about time someone stood up. Cops and dea didnt want to take care of it so he tried now it has the attention it needs for people to educate themselves and their children. All I can say is had it been my child I would have done the same thing probably worse. Thank god his son is ok alot of people in this world are not all due to this syntetic crap..

I can drink one or five and be happy. I used to spend the whole night out and drive with no thought about who would be harmed. When I was a young man. Then I grew up. I was lucky not to harm anyone. I was lucky in many ways.

The Waltons is based on a real family who lived during the depression. It is just a great show about the way things could be with a little hard work. People need to stop saying everyone else is at fault. Roll up the shirts and start working. People now a days are lazy.

If it takes standing in front of these places with signs, that's what it takes. They need to go.

The president signed a law the first of the month" so what they were selling was ILLEGAL" his son bought the stuff at Tedd's which was raid" and the very next day all the Tedd's were raided nation wide" this is how out of control this drug is" that the headshop owners were changing the name and misrepresenting the drug" this drug is so out if control that when the police raided Tedd's people were walking into the store to buy it as police were there"and it didn't even faze them"

If any of you were paying attention his main reasoning behind going to the head shop was not just because of his son but to stop it being sold to other kids as well. He didn't want other parents to have to go through what he felt for his son that day. I commend him for his reasoning.

I have read every article and comment I can find and not one states a true fact,Fact is Mr.Avery knows what he did was wrong and is very aware of the concequences and he is ready to except the punishment he receives. Another fact. Bath salts are illegal.period. If my child did come home intoxicated would I beat the bar or liquor store? NO because no one dies from 1 beer.Bath salts kill.As for his legal record. NO ONE seems to mention the 30 years inbetween his offenses was lived clean and clear of any type of "legal issue". He lived those 30 years raising his family. Now the 24 year old son,Mr Avery is first thankful his son is alive.Common sense would tell you he is very angry and is taking all the neccesary steps to be sure his son never takes anything again.The son is learning a hard lesson from all of this as he should.Mr. Avery is obviously not only trying to help his son but your son and your neighbors son your nieces, nephews, friend,...from doing this drug, and please, those who say not me and not my son and point fingers should be aware,you would be shocked to know who is doing these drugs and many other types of drugs.Mr Avery was in that catagory, "Not my son" Its part of why he reacted the way he did it was a shock to him that his son tried this bath salt.
This isnt a question of was it right or wrong to go after the head shop with a bat.We all know that was wrong and illegal and he will pay for that. The question is, now that he made the mistake in using the bat and he has created alot of focus on the issue.we ask will you support us in stopping these synthetic drugs from reaching our children and adults alike.

Oh no didn't you hear. Our government has now decided that you are not officially an adult until the age of 26. At least that's their case for health insurance. However, you can be an adult at 18 to vote and die in a war, and you can be an adult at age 21 to drink. Kudos to this guy for breaking up the place.

In a day and age when stand up dad's are few and far between I hope Mr. Avery doesn't spend one minute in jail.I have 3 son's 27,25 and 23 and if anyone sold them something that put them in the hospital I would be irate at my kid and at the people they got it from.I would wager that Justin is hearing day after day how bad he has messed up and at his age rightly so. Tebb's got a few broken display cases a window that was replaced almost immediately by what I saw on the news, but Justin is going to live the rest of his life knowing he disappointed his father who obviously adores him.What is going to happen to the owners of Tebb's? Nothing. they will open up put a different label on the stuff and go on like nothing happened. Anything for a buck.

Iam all against selling drugs/bathsalts in a buisness, but this man is a 24 year old man, nobody forced him with a gun to go in to this shop and buy.

A drug addict has always ways to get his drugs, after that shops are closed, he will find other ways to get his drug of choice.

I hope Mr. Avery gets also behind all this drug dealers who selling to kids and young people.

And have a serious talk with his son.

This isn't some young "kid", he is a 24 year old adult. His friend had a bad trip on the stuff three days before and this guy goes out and voluntarily buys and takes the same drug. This father has no right to destroy property and threaten people because his kid is an idiot. . Everyday the news is full of morons in the hospital or jail over these drugs, Anyone who willfully buys this stuff deserves the consequences.

I say convict him for the crime he committed!

So sad that the mayor has a blog like this to try to sway emotion for his political agenda. Politicians have no shame what so ever.
If it were my blog: whether a public likes or not would go like this "It's sad that Avery is being shown as the vigilante martyr. What he did was premeditated. Whether the products Tebb's is selling is harmful or not has no bearing. People choose to smoke even though there is surgeon general warnings on every pack of cigarettes. People decide to drink more alcohol than they should. Now these bath salts should not be consumed. But in all fairness to Tebb's or any other head shop out there, there is a warning on the package saying not for human consumption. So I say stop making excuses for the abusers and vigilantes. Stop making them the heroes. As of now those products are illegal. Lets have faith in the legal situation and take care of its self. If we don't, what's to stop a parent from going on a rampage next time at McDonalds, because their child got obese from eating to much fast food. Avery needs to pay the price. And hopefully young Avery who I'm sure has done more substances that he has led the public and friend know learned a lesson about drugs. "
That being said the mayor is playing a numbers game about people that would side with him. Don't be fooled. This man has no love for the people of Watertown. Only love of the political prestige and the money he gets from the alcoholics that drink at his hole in the wall bar.
Oh and Mr Mayor- you won't allow this post most likely. However, it will be printed in the Rochester Democrat and Chronicle.

just to be clear, the OP is actually saying that they have the wrong guy and he couldn't have done it because he "was in the emergency room at the time." of the incident....but he has been interviewed and said that he did it, called the police on himself and waited there....seems pretty cut and dry, who gives a shit about his motive. Law is law, and breaking shit is not the way to change it.
