Three trials and five years in prison and no conviction has left Wayne Oxley a little bitter towards the establishment in the Maple City.
The once accused and actually convicted but later overturned murder suspect was actually found not guilty in his third trial.
Now he wants his emotional suffering paid for by the City of Ogdensburg.

They should file a countersuit against him.
Just because they could not hold him accountable beyond a reasonable doubt does not mean they could not hold him accountable with the preponderance of evidence.
As a taxpayer, I believe we should put District Attorney Duve on trial. What is going on up there?
I see the armchair lawyers are out in force. Put yourself in his shoes (assumes you are innocent until proven guilty). He should be compensated . that much, up to a jury probably. The same kind that found him not guilty.
One cannot advocate equal justice under law and then pick and choose decisions from that system.
But, hey, that's the trendy times we live in - be nasty, against everything and everyone, and seldom be for anything, right?
The not guilty verdict rendered was obviously because there was a reasonable doubt.. Not because he didnt do it but there was a reasonable doubt..
The reasonable doubt was created by the Ogdensburg Police Dept and three of its officer who lied in court...
The reasonable doubt was created by Gary Miles actions at the time of the arrest when Oxley yelled to the husband of a lawyer that he wanted help from his wife.. Miles laughed it off and the trooper present when it happened couldnt recolect...
Its not Oxley who should be sueing the city of Ogdensburg but rather the taxpayers should be sueing the city for the officers misrepresentation during this trial.Whatever he wins and he will win something if its just a small amount to go away will come out of the city accounts and affect their insurance reates..
Remember firing the city manager cost about a quarter million dollars from the city funds which Nelson and council keep under wraps now this...
This bill will continue to rise as Ogdensburg is lost in the first steps of a Manager search while the mayor plays Mr. Important for the mayors association rather than dealing with his everyday duties at home..

Danny you keep getting dumber every day. Everyone prosecuted that is not found guilty does not deserve to be compensated. Only victims of malicious prosecution deserve to be compensated.
This guy went through it 3 times.
And all he had to do, is get enough doubt that it was deemed reasonable doubt, to find him not guilty. He had 3 chances to do that and he finally did it on the third try.

Just because he can't remember beating another human beiing to death with the bloody bat that was in his house doesn't mean he is not guilty. It only means he was smart enough (or his lawyer) to bring it up in court that he was so wasted that he doesn't know what he did. So he walks. I myself would feel good on that point. Most of the years in question he worked his job and lived it as it went. MAYBE he should have not been involved with said people who end up using drugs and dead? Do you (Danny) hang around with drug dealers and the such? I don't. So I don't have to worry about bloody bats on the back porch.
