WDT: Comedy Club Owner Prevails Years After Damage Was Done

Here's another example of vindication coming at a cost...In this case for Mike Kinnie it was years of legal expense and angst because the business you worked for is on the line. It's a fact of life that in politics there is a lot of "gotcha" moments and if you are going to be in certain regulated industries you better include a line item in the budget each year for lawyers. It's very easy to go after a seller of the "devil's brew" in the same way politicos find it easy to impose "sin taxes." Kudos to Mike for fighting back and setting prescedent and not just paying a fine to make it all go away, which is of course what the system wants. I know he moved on to another job and don't know if he still has the Comedy Club, but all of us in the biz wish him well and compliment him on fighting the good fight. He should now promptly file suit for malicious prosecution. The ruling shows that the law was very clearly in Kinnie's favor and the prosecutor must have know that if they were competent.

The police officer was malicious and targeted this good citizen and therefore violated his civil rights.

What happened to the Gambino charges?
Didn't they roll some dice on the bar for 25 cent de minimis sign in or something like that?

The Liquor Authority makes up their own laws. Since licensees are scared and have limited resources they usually just pay up and shut up.

Many only wish he would have thought through the issue of a prison in Sackets. Right now, with the impending closure of Watertown, a new one providing jobs up here would have been nice. A generation of guys have to drive to other parts of the state because of Mike Kinnie. We never would have known it was there, except for paydays.

So right in that statement you are telling why the dude was facing charges in court and no longer has a bar there.... aren't you?

IIRC...his story was, as mayor he tried to cut the po-po department and the po-po responded in kind by harassing him with selective enforcement of the subjective law, and went on to sick the Liquor authority on him.

hmmmm...but that does not explain why the liquor authority did not back off even though case law was crystal clear.
