McGrath Appeal Filed...Multi-Judge Panel Next Stop

The McGrath appeal of his ballot tossing seems reasonable and well stated, but its more semantics than anything. Also, it depends on who is drawn to hear the case at the appellate level.
The matter will be heard next Monday and a quick decision is likely since its an election law case.

A commenter says McGrath has been left off the Jefferson County Democrats website.

Jeff- my experience is that it is a five judge panel and you need three judges to agree with you to win.

also, as I referenced on another thread, the Jefferson Dems seem to have written off McGrath. they don't feature him om their new website.

If he is not toast, Blankenbush is royally screwed. Regardless of what the Mayor has been saying on this blog, the press that people really read has very much been in McGraths favor. Blankenbush has been very effectively painted as a scared career politician running away from a fair fight, exactly what the people of this state are sick and tired of. This will be a fun race to watch if McGrath gets back on the ballot.

12:44, if you are correct, that is ,interesting. Provides a little more insight into Mr. Bbush, and the "True North(to Albany) Plan ",that he wants to represent. I am not in favor of everything the Democrats do, but this looks like another classic example of , "do as I say, not as I do" type , that the Republicans chastise the Democrats for.

And this was based on improper signatures? I can't believe they were that incompetent.

It's not based on lack of signatures, or any fraud. It is based on a stupid word argument about what his petition listed as the office he is seeking. This will be reversed on appeal - snowballs chance in hell? In your dreams Kenny B. These stupid trial court rulings get reversed ALL THE TIME by the appeals court, who are not as blatantly political. As for the Jefferson Dem website - they only include people who are currently in office. Sorry premature burielist, nothing more to read from that.

McGrath WILL be back on the ballot and will win this race.
