Judge Zwack Was Very Much a Part of Bruno Country Before Elevation to the Bench

Well, I read Judge Zwack's opinion on the McGrath petitions as well as checked out his biography.
The 58 year old father of three is from the Bronx, went to Siena College and served as Renssalaer County Executive, where he was embroiled in corruption charges. He was acquitted.
Governor Pataki appointed him to some alcohol agency before putting robes on him in an out-the-door appointment. Renssalaer County (Troy) is of course the home base for former Senate Majority Leader Joe Bruno.
He has much to be thankful for, and in a close call decision he has good reason to help his party. Whether he did or not, God only knows.
His decision on the petition form is that since judicial delegates and state committee people are also elected based on Assembly district boundaries,there could be confusion among the petition signers.....The phrase "New York State Assembly-122nd District" is , according to the judge, a geographic designation that does not describe the office. The judge says the lack of clarity brings into question whether the signers knew what they were signing.

Honestly, it doesn't seem to bother you GOP'ers at all that a crooked judge wants to be the one who casts the single ballot for Assembly.

I signed McGrath's petition and knew what I was signing, There was no confusion to me. None at all.

There was no confusion nor is there any confusion on whats happening.. GOP desperation move has been get lawyers involved and nit pick the petition to death. Any reasonable person knew what they were signing and any any reasonable person knows that. Blankenbush and Forsythe just lost a lot of votes...

McGrath is desperate to stay on the ballot and probably just slipped the Mayor a c-note to keep this boiling on his blog. Good gracious, the judge here was found innocent and acquitted of the charges...throw Rangle out of Congress before Dems can start claiming to be saints...the Dems are going to elect Hiram Monseratte back to the Assembly this year...welcome back Senator Slasher.

Jeff, we're all tired of this story and McGrath is just grasping at straws.

Ken turned in the necessary petitions correctly and I'm sure Democrat election attorney's review them and said we can't throw out enough.

McGrath turned in a smaller number of petitions...there was errors and a JUSTICE OF THE SUPREME COURT OF NEW YORK ruled that they were invalid.

DEMOCRATS YOU HAVE ONE PERSON TO BLAME HERE - BRIAN MCGRATH.

Yes, go ahead and BLAME BRIAN MCGRATH FOR FIGHTING FOR OUR RIGHT TO VOTE. Shame on him for that, if he only learned to speak Albanese, he'd know you let politic bosses and crooked judges fix elections so that you don't have to bother voters.

546 - McGrath is nothing but politics. He wanted to run for Congress, but we picked Owens so this is his consolation prize. Oops...he screwed that up and now gets nodda.

And, if McGrath did have "lawyers and the Democratic party" check his petitions, then those attorney's should be disbarred and those in the party should be thrown out for incompetence.

McGrath's notary commission expired and a judge ruled that the signatures that he circulated using that notary were invalid. Jude had a story on it somewhere...that could be a second issue here.

First, is the labeling of the petition and then the expired notary.

Lol, now more than one judge has ruled against McGrath. I suppose he is corrupt as well. This seems to be open and shut against Brian. I liked him at first now I just think he doesn't respect the law.

It is distrubing, but it is also reckless. McGrath is trying to spin this into a sympathy vote and that the Republicans stole this election - completely false. If this case had been heard in this area I would hope that a Supreme Court judge would have ruled similarly.

As a Lawyer I can't believe an officer of the court (Brian) would post something about a judge on his facebook. I was on his side until then. Respect the courts. Shame on you. And now another judge ruled against him. Apoligize Mr. Mcgrath. I assume this is how things are done in NYC but don't act like that in the N-Country.

Isn't the Albany Courts a very Democratic Area. I can't believe Blankenbush and his lawyers even filed down there. That was kinda risky. I like Brian but if he is particpating in this Judge bashing he is not the person i thought he was. This is not the type of person i want to choose from.

Albany is an interesting location to challenge the case, but I suppose they probably have more experience dealing with election law. McGrath just screwed up multiple things in this election and deserves whatever he gets. Lewis County Dems have jumped through hoops for this kid and I'm betting some of them are kicking themselves now.

Hey idiots, yes, there is a second opinion, but it was the same issue. And, NO, there was NO ruling of any Fraud related to the notary commission, in fact just the opposite. Continuing to suggest otherwise is defamatory. But I guess you don't care about facts.


The ONLY two issues here are a word or lack of one, and a fear to face voters.

All the rest is just Albany/RACC spin.

Nobody ever answers this question: why is Ken afraid ti face voters? What is ge hiding?

Busy Albany Republicans blogging last night. I love how they feign ignorance about things and then answer their own questions in subsequent replies. So cute. I also love how they pretend that Albany isn't corrupt, including judges from Bruno country. So funny. And then to cap things off they just make up stuff about notary commission rulings that don't exist to try and skim a good guy, or make up things about what Brian posts on facebook to try and suggest he doesn't respect courts. So pathetic.

You all really don't want to face voters now, you have demonstrated exactly why Ken isn't fit for office if all he is going to do is take marching orders from you Albany idiots.

Notary issue truth: he submitted affidavits to the court backing up his valid use of it 100%. Stop trying to suggest anything else! He did nothing wrong with that.

The only thing wrong here is your obsession not to ket voters vote because McGrath didn't wear his Members only jacket while collecting signatures.

Oh, and despite popular fiction by Republicans, the judge did NOT find McGrath did anything wrong with his valid notary commission, but nice of you to make that up.

The Notary was in now way shape or form valid. That is undeniable just ask Jude. It was not ruled on if it was fraud according to any papers I read. A candidate definetly used a notary stamp illegally that is without question. Some argue i guess that causes the entire petition to be thrown out. Lets not forget this. I think this is a bad sign of character for lawyer.

My oh my, Kenny and the GOP are mighty fearful of little ole Brian aren't they? If Ken can't stand up and face the voters what do you think will happen to him as a member of a very small minority in the NYS Assembly. Rather than have Kenny as our Assemblyman, better to save the taxpayers money and tell him to just stay home and collect his salary and save the per diem and travel costs. He won't - can't do anything for us anyway. We demand a choice!

9:16 - a.k.a defaming slimmer - the notary issue WAS ruled on, by BOTH judges, and was found that McGrath acted properly. Why don't you actually read things rather than make them up to make his seem dishonest.

Right 11:47, ask yourself that answer, I mean, RACC. The judge ruled on it in court and in chambers. But go ahead and keep that story alive with lies, maybe you could use a defamation lawsuit, since you seem to like court so much.

Oh, and what is your answer to the FRAUD Ken committed by signing a cover sheet on his Independence Party Petitions stating that he had enough signatures to qualify for the ballot. Oops, he wasn't even close - even assuming every single signature he submitted was valid. Speaking of FRAUD, how about we start talking about Ken's wind deals. I mean, I know you are hoping their won't be an election for voters so that his FRAUD there isn't exposed to voters.

McGrath is a lawyer. If the shoe were on the other foot, he'd have done the same thing. Albany is so corrupt because of the multitude of lawyers that inhabit it. Poetic justice for another lawyer. Like all other lawyers, he's a snake in the grass. Too bad the republicans don't have anyone better than BlankenB.
